Instagram contest "CAS-mas Holiday Drop: Power Edition"

1. Organizer

The organizer of the Instagram contest "CAS-mas Holiday Drop: Power Edition" (hereinafter referred to as "contest") is Metabowerke GmbH, Metabo-Allee 1, 72622 Nürtingen, Germany (hereinafter referred to as "organizer"). This contest is in no way connected to Instagram and is not sponsored, supported, or organized by Instagram in any way. Instagram is not a contact for this competition and accepts no responsibility for it. By participating in the competition, all participants acknowledge that any claims must be made exclusively against the organizer.

2. Eligibility

All natural persons who have an Instagram profile at the time of their participation in the competition, are at least 18 years old and are resident in one of the following countries are eligible to participate: EU member states, the United Kingdom, Switzerland and Norway (hereinafter referred to as "participants"). Employees of the organiser and its affiliated companies as well as their relatives are excluded from participation. Participation with fake identities or with the identities of third parties is not permitted. Automated participation (e.g., via participation and registration services) and multiple entries are also not permitted and will result in exclusion in accordance with section 4 of these terms and conditions.

3. Prize & closing date for entries

1. The winners will be selected at random from all participants no later than [7 days] after the end of the competition. The winners will then be notified of their win by the organizer via private Instagram direct message and asked to provide their contact details (first and last name, address) via private Instagram direct message for the purpose of sending the prize. If the contact details are not sent within [14 days] after the organizer has notified the winner of their win, the prize claim will expire. The same applies if the prize cannot be delivered to the contact details provided. The organizer is not obliged to investigate. In any case, a replacement winner will be selected from among the remaining participants. Once the contact details have been received, the prizes will be sent within 30 days. The prize will only be sent to the countries listed in point 2.
2. The prize will not be paid out in cash, cannot be collected, and cannot be exchanged. Any prize claim is non-transferable.
3. Two prize packages will be raffled off among all participants, each consisting of a Metabo BS 18 L BL Q cordless drill/driver including a "Quick" 28 Nm quick-change angle adapter, a PowerMaxx BS eccentric attachment, and a CAS package (2x CAS 5.2 Ah Li-Power battery, 1x ASC 145 quick charger, 1xCAS MetaBOXX) with a total value of €750 each. Each participant can only win one package. Further details, images, and information about the prizes can be found in the corresponding Instagram post about the competition.
4. Participation in the competition is possible until December 12, 2025, at 11:59 p.m. After that, participation is no longer possible.

4. Exclusion in case of violations

The organizer reserves the right to exclude participants from the respective competition at any time for good cause. Good cause shall be deemed to exist in particular if these conditions of participation are violated, legal regulations or the rights of third parties are infringed, or content such as comments of a pornographic, obscene, discriminatory, racist, or violence-glorifying nature is posted. The organizer reserves the right to remove such content without notice. The same applies to manipulation or attempted manipulation, interference with the proper conduct of the competition, and threats or harassment of other participants or third parties.

5. Changes and interruption of the competition

The organizer reserves the right to adjust the procedure, conditions of participation, or dates of the competition if there is an objective reason for doing so that was not foreseeable at the time of the competition. If the competition cannot be held for technical or legal reasons, it may be interrupted or terminated at any time without the organizer being liable.

6. Miscellaneous

1. The organizer is expressly not responsible for Instagram's websites or data processing by Instagram. In this respect, Instagram's privacy policy and terms of use apply exclusively.

2. The organizer accepts no responsibility for data loss, in particular that which occurs during data transmission, technical defects, or lost or delayed submissions, which are attributable in particular to network, hardware, or software problems.

3. Legal recourse is excluded to the extent permitted by law. German law applies exclusively, excluding international private law and the UN Convention on Contracts for the International Sale of Goods.

4. Should individual provisions of these conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid clause shall be replaced by the statutory provision that comes closest to this provision.

7. Data protection

The organizer processes participants' personal data only to the extent necessary for the purpose of conducting the competition. The data will not be used for any other purpose. For further information on data processing, please refer to the following data protection information:

To participate in the competition, the participant must first provide their Instagram username. If the participant is selected as the winner, their first and last name and address must also be provided so that the prize can be sent to the respective winner.

The participant assures that the information provided is true and correct.

We process the participants' personal data for the purpose of conducting the competition, including to determine whether they are eligible to participate, to identify and notify the winner via Instagram direct message, and to send prizes to the address provided. All data required for determining the winner and sending the prize will be deleted no later than 30 days after the end of the competition.

If the participant does not provide us with the aforementioned data, it will not be possible to participate in the competition or to contact them regarding a prize notification or to send a prize.

The legal basis for data processing in the context of competitions is Art. 6 (1) (b) GDPR.

Your data will not be passed on to third parties unless this is necessary for the purpose of conducting the competition or sending the prize.

Participants have statutory rights of information, modification, and revocation.

• Package 3: Scangrip NOVA 2 CONNECT work light including a CAS package (2x CAS 5.2 Ah Li-Power battery, 1x ASC 145 quick charger, 1x CAS MetaBOXX) with a total value of €560

Each participant can only win one package. Further details, images, and information about the prizes can be found in the corresponding Instagram post about the competition.

4. Closing date for entries

Participation in the competition is possible until December 19, 2025, at 11:59 p.m. After that, participation is no longer possible.

5. Exclusion in case of violations
